Terms of Service

These terms govern your use of habitlume. Please read them carefully. By using the service you agree to be bound by them.

1. Acceptance of Terms

By creating an account or making a purchase on habitlume (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and Meltian Advertising Solutions ("Meltian", "we", "us", "our").

2. Description of the Service

habitlume is a web-based calm habit and mood journal provided as software-as-a-service. Access is sold as one-time lifetime purchases that unlock specific tiers: Spark, Ember, Whisper, Grove, Atlas, Keeper, and Lantern. The Service is provided on an as-is basis and is intended for personal, non-commercial use.

3. Account Registration and Eligibility

You must be at least 16 years old to use habitlume. One account per person. You agree to provide accurate registration information and to keep it current. You are responsible for keeping your credentials secure and for all activity on your account. Notify us at support@habitlume.app if you suspect unauthorized access.

4. Purchases and Pricing

habitlume is sold as a one-time purchase per tier. There is no subscription, no automatic renewal, and no recurring charge of any kind. You pay once for the tier you choose and retain access to that tier for the lifetime of the Service. If you elect to upgrade to a higher tier, you pay only the difference.

All prices are listed in United States Dollars (USD). Applicable sales tax, VAT, or other transaction taxes may be added at checkout based on your billing location. The current tiers are:

  • Spark - $2.99
  • Ember - $4.99
  • Whisper - $9.99
  • Grove - $19.99
  • Atlas - $39.99
  • Keeper - $59.99
  • Lantern - $84.99

Payments are processed by a third-party PCI DSS Level 1 certified payment processor. We do not store full card numbers on our servers. Charges will appear on your bank or card statement as HABITLUME*MELTIAN.

5. Refund Policy

Every plan includes a 14-day money-back guarantee. The full terms, eligibility, and process are described in our Refund Policy, which forms part of these Terms.

6. License and User Content

Subject to your compliance with these Terms, Meltian grants you a personal, non-exclusive, non-transferable, revocable license to access and use habitlume for your own personal use. This license does not transfer ownership of any part of the Service.

You retain full ownership of the journal entries, habits, mood logs, and other content you create within habitlume ("User Content"). You grant Meltian a limited, worldwide, royalty-free license to host, store, back up, transmit, and display your User Content solely as needed to operate the Service for you. We do not read your entries, do not sell them, and do not use them to train artificial intelligence models. Our handling of personal data is described in our Privacy Policy. Our use of cookies is described in our Cookie Policy.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to store unlawful content
  • Harass, threaten, or abuse any other person through the Service
  • Infringe the intellectual property or privacy rights of others
  • Resell, sublicense, or commercially exploit the Service
  • Attempt to reverse engineer, decompile, or extract source code
  • Use automated systems to scrape or harvest data from the Service
  • Interfere with or attempt to disrupt the Service or its infrastructure

8. Service Availability

The Service is provided "as is" and "as available". We work on a best-effort basis to keep habitlume available but do not guarantee uninterrupted or error-free access. We may perform planned maintenance, release updates, fix bugs, change features, or discontinue parts of the Service. If we ever have to shut the Service down entirely, we will provide at least 90 days notice and a full export of your data.

9. Termination

You may delete your account at any time from Settings, Data and Privacy. Deletion removes your account and associated User Content from our active systems in line with the retention periods described in our Privacy Policy.

Meltian may suspend or terminate your access to the Service if you materially breach these Terms, misuse the Service, or use it in a way that creates legal or security risk for us or other users. Where reasonable, we will give notice and an opportunity to cure before terminating.

10. Disclaimer of Warranties

habitlume is a journaling and self-tracking tool. It is not a medical device, a therapeutic service, or a substitute for professional mental health, medical, or psychological care. We make no health or medical claims. If you are experiencing a mental health crisis, contact a qualified professional or, in the United States, dial 988 for the Suicide and Crisis Lifeline.

To the maximum extent permitted by law, the Service is provided without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Meltian Advertising Solutions shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the lesser of (a) the amount you actually paid to Meltian for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred United States Dollars (USD 100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Meltian Advertising Solutions, its officers, employees, and affiliates from any claim, loss, liability, or expense (including reasonable attorney fees) arising out of your misuse of the Service, your User Content, or your violation of these Terms or applicable law. Meltian will likewise defend you against any third-party claim alleging that the Service, as provided by us and used in accordance with these Terms, infringes that third party's intellectual property rights.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles. The exclusive jurisdiction and venue for any dispute arising under these Terms shall be the state or federal courts located in Los Angeles County, California, and the parties consent to personal jurisdiction in those courts.

14. Dispute Resolution

Before filing any claim, you agree to first attempt informal resolution by contacting us at support@habitlume.app or +1 (833) 364-3410 with a description of the issue and your desired resolution. We will work in good faith to resolve the matter within 30 days. If we cannot, either party may then bring the dispute in the courts identified in Section 13.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify users by email or in-app notice and post the updated Terms on this page with a new "Last updated" date. Continued use of the Service after the changes take effect constitutes acceptance.

16. Severability, Entire Agreement, Assignment

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, Refund Policy, and Cookie Policy, constitute the entire agreement between you and Meltian regarding the Service and supersede any prior agreements on the same subject. You may not assign or transfer these Terms without our prior written consent. Meltian may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets, on notice to you.
